@Leoboudv: sadly I do not know who can restart the bot. I hope the notice will reach someone.
I have not followed up on the PDM files for some time. I hope most of the files are either deleted or "saved" by a DR. Did you have any time to follow up? --MGA73 (talk) 14:10, 31 May 2024 (UTC)[reply]

I knew It was a Stemoc who know works on this problem...just not Stemoc2. I had forgotten. As for the PDM files, I know some people have uploaded PDM files as cc0 as this category shows but the bot still does not allow PDM image uploads.  Comment: Dear Michael, Firstly, please check my new Email to you about Koller's CORRECTED Email address...which is actually suillellusadonis WITH TWO LL characters. Please send him a Wikimedia Email to this corrected address at gmail.com. Secondly, the mycoportal image links to Mushroom Observer (MO) here: https://mushroomobserver.org/images/189613 (I have signed in to the MO site) where Mr. Koller changed the license of his image to CC BY NC SA 3.0. on October 6, 2017. It has been this license since then to today. That is why an OTRS ticket is necessary from Mr. Koller. In reality, Mr. Koller changed the license on ALL his 20,533 mushroom images to CC BY NC SA 3.0. on October 6, 2017 at Mushroom Observer...after I checked his other images. Wikiversity fair use files of Marshallsumter

Hi Michael!

Please move all of my fair use files to the Keep category you mentioned in your note to me. A number of the resources and courses I created including Radiation astronomy have been moved to user space since I was blocked by Dave Braunschweig for repeat use of incapable copyright information. As you know USA copyright law and fair use law with case law are separate entities. Any fair use file that is used in a thumbnail has been transformed by the use of the thumbnail image to free use. I can indicate where you can confirm what I've written here in USA case law if you need it. Any EDP that abridges USA fair use law is actually illegal technically.

Hi Marshallsumter! Fair use is only allowed if there is a valid fair use rationale. For example v:File:Definitions-demotivator tomatoes.jpg. What prevented you or any one else in taking a photo of a tomato and make a similar file? Or v:File:Island of Corvo from Flores.jpg? It is not enought that you can't find a free file but you also have to make sure that we can't "... reasonably expect someone to upload a freely licensed file for the same purpose". If it only were a few files I'm sure someone would have been willing to spend the time going through the files but you uploaded so many files.
Moving all the files to the keep category would only make community ignore the category. --MGA73 (talk) 19:30, 5 June 2024 (UTC)[reply]
Hi again! You've missed the point of what I mentioned above. Our EDP's require "fair use is only allowed if there is a valid fair use rationale." USA fair use no longer does because it is a separate set of laws and case law from copyright law, after the case rulings of 2020 and 2021. Any file uploaded and used as a thumbnail has been transformed to a free use file by its display using a thumbnail. It's that simple. The uploaded file should also be displayed in a thumbnail if there's any concern that the uploaded file is an exact copy of a copyrighted file. There's no need to look for a free file by USA fair use law and case law! In fact, all transformed fair use files because they are now free use are allowable on Commons though popular opinion here or on Wikiversity is likely to disagree. If there are any of my files remaining that do not have a rationale from when they were uploaded I can supply one but as I mentioned if they are used in a thumbnail they have been transformed to free use or as mentioned here at the bottom of this page: "By saving changes, you agree to the Terms of Use, and you irrevocably agree to release your contribution under the Creative Commons Attribution-ShareAlike 4.0 license and the GFDL." --Marshallsumter (talk) 00:25, 6 June 2024 (UTC)[reply]
Hi Marshallsumter! Just because something is or might be legal it does not mean it is welcome on wikimedia projekts. Non-commercial licenses are legal but still they are not welcome. I'm familiar with all of the above and was in the process of making certain all of my fairuse images had a rationale. Dave's block may have prevented me from completing that review. Wikiversity's current EDP was modified by one user without consensus approval or even comment to what it is now. Implied consent does not apply. That individual no longer edits Wikiversity. But, Wikiversity was set up to allow fair use. Fair use does not involve the copyright holder since 2021. I can't stop you from deleting my images and WMF legal is aware that currently transformed copyrighted or presumed copyrighted images are free use. Fair use images transformed by the use of thumbnails are free use but are not welcome because of overly restrictive EDPs which actually violate wmf:Resolution:Licensing_policy goal of free use for all images, even copyrighted ones. The problem on Wikiversity to which we agree is USA free use images are legal "but still they are not welcome." These same images are also legally free to be on Commons "but still they are not welcome." This latter viewpoint is also against the goal of the wmf:Resolution:Licensing_policy. Hi Marshallsumter! Personally I think it would be much easier if there was a place like Commons for all fair use files. It does seem like extra work that every wiki have to make sure a photo qualify as fair use. And some wikis do allow pretty much everything. Even if fair use is allowed there is no rule saying that all wikiprojects have to allow fair use. I think fair use works best for the big wikis because there are many active users that can help monitor. --MGA73 (talk) 18:38, 6 June 2024 (UTC)[reply]
